    The family of the Thai girl who lost both her legs in an MRT accident is suing SMRT for S$3.4 million.

    The transport company confirmed that it received the writ on Friday after it was filed in the High Court.

    The amount which the family is seeking is equivalent to the price for the 20 pairs of prosthetic legs that Nitcharee Peneakchanasak, 15, will need in her lifetime said her lawyer, Cosmas Gomez.

    Gomez's law firm, Cosmas and Company, specialises in personal injury claims.

    Medical experts said Nitcharee, who returned home to Thailand earlier this week after having both her legs amputated, would need a new pair of custom-made legs every three to five years, depending on how fast she grows and the rate of wear and tear.

    The estimated price for each pair of legs is at least S$150,000, which would work out to be about S$3 million over the course of her life.

    The cost of the legs is reportedly higher in Bangkok -- roughly S$200,000 per pair. The teenager is now at the Sirindhorn Centre receiving physiotherapy and being prepared to receive her first pair of prosthetic legs.

    The girl's father, Kittanesh Peneakchanasak, 56, said the S$5,000 compensation sum initially offered by SMRT was "unacceptable".

    He explained that the family was not trying to ask for more than what they needed, but "just enough" to cover his daughter's medical expenses. SMRT has also declined further comment, saying its discussions with the family were private.

    Nitcharee, who was in Singapore for a holiday and to study English from Trang, Thailand, fell from the platform at Ang Mo Kio MRT station onto the tracks in April.

    One of her legs was severed by a train pulling into the station at the time, while the other leg was so badly mangled that it had to be amputated in hospital later.

    Over $400,000 in donations and gifts from donors have also poured in for Nitcharee, whose cheerful and positive attitude has won her an army of fans.

    The lawsuit is expected to reveal the exact circumstances of how she fell onto the train tracks. Gomez will also request SMRT for a copy of the CCTV video footage of the incident to be used as evidence.

    Her father, an insurance agent, also dimissed earlier media reports which said his daughter had "fainted" before falling onto the tracks.

    "She was fully conscious when it happened. The platform was very crowded," he said.

    "She didn't faint... so something must have happened."

      Singaporean has been too kind. Now she took the 250k - 400k donation to thailand and use as a fund to sue Singapore MRT. What an irony, no wonder she give such a nice smile at our airport.
      Her careless , become MRT station problem. I dun think our MRT station design to make people drop down. I wonder should SMRT counter sue her, for created jam at station and waste SCDF time to pull her out.

        If you lost your two legs, you'll be crying like a baby everyday in your bedroom. Please don't insult that strong and cheerful girl. She has shown strong determination even she has lost her two legs.

      there must be some kind of surveillance cameras on the platform that captured the accident... Anyhow, I have 2 boys (age 8 and going 5) and we live in Manhattan . We always take the subway (which is the MRT in New York City) and I make sure that I hold on to their hands and not let them run around on the platform while waiting for the train. My point is, what was the girl doing that time and who was with her? What was she (and whoever was with her) thinking? Standing so close to the track? Where is her safety measure??? New York City Subway system is a lot more dangerous (safety wise) and complicated than the Singapore MRT. I wonder how did it happen..........

      First the newspaper said she fainted and fell onto the track.

      Now her father said that she did not faint. Something must have happen.

      Her father was an insurance agent. He must have knowledge on how the accident should have happen to favor compensation.

      I hope to see the high court give SMRT and the girl a fair trial.

      LTA approve the open concept platform should be sued.

      I hope that this is will not be a case to exploit the loophole of our law system.

      Even she win the case, I hope that the compensation will be given to them in small parts. This is to avoid huge compensation payout and the money is used for other purpose.

      Remember, a few years back, the China women her daughter get murder in Singapore. The newspaper reported that the chinese women use the money that people donated for her daughter funeral to buy land and property in China.

        Many years ago, Singaporeans contributed to a foreign worker who lost both her arms in an industrial accident. Sympathy was very high all round and she got monies enough to support her family for life.

        Many years down the road, we learn that she got married shortly after she returned home, big new house, children, maid etc... Goodbye and thank you, Singapore.

        It is good to be kind - but it is better to be wise.

      I recalled that MRT mentioned that it cost millions of dollars to fence up the open area at each station. I hope they sit up now that foreigners are quick to sue for the loss/accidents . They seem slow to react.

        having the open platform will always pose risks to accidents no matter how aware the commuters are . and worse off , it opened another option for intended individuals seeking departure forever.

        smrt for sure needs to pay for this young child support for her while life, not just the artificial legs support. since smrt has not wake up from the number of these incidents, smrt will need to bear the cost. this cost should not be charged back to communitors.

      SMRT could study the possibility of drawing the yellow lines 2 metres away from the edge of the platform. If anyone were to faint or being pushed, he or she would still be on the platform. Moreover, this would allow alighting passengers to walk out freely with no congestion.

      Safety barriers are important but more so are the commuters' behaviour and attitude. There was once at Tampines mrt, I was walking to queue up when suddenly a man walked backwards and bumped hard into me and I stepped a few steps back. Luckily for me I didn't fall but sadly that man behaved as if nothing happened. It was also the norm whereby the train is arriving in 2mins and people would hog the queue lane as well as stepping beyond the yellow line making it hard for people to queue and also dangerous should these inconsiderate commuters suddenly bump into you etc. There are so many lousy behaviours displayed by commuters at mrt and these should be rectified. When I was in Bangkok I ran for the train and I was confident it was safe for me to catch it as everyone has already board. But i freezed when the warden blew a whistle at me signalling me to stop running. It was a sharp whistle and definitely embarrassing but I felt full of respect for their standards. People in Bangkok queue for the train and do not cut queue which is always the case in Singapore and its really vexing when you were the first one to queue but when the train arrive they just stepped in front of the door exit making you look like an idiot when they are the shameless ones. SMRT should employ wardens to monitor human traffic during peak hours and not just put 1 or 2 wardens loitering around the whole MRT telling people 'Please stand behind the yellow line' or 'Please let the people in the train alight'. Absolutely lame.

      i have a suggestion!! suppose we have a traffic light for incoming trains...let's say they stop a few meters before reaching the platform. then when the coast is clear...when there's nobody lying on the tracks.....we have the green light for them to s-l-o-w-l-y roll in....that way we can also see if someone purposely jumps in at the last minute to commit suicide. how about that?

      A RICH Singapore is opening a floodgate for exploiting foreigners to make insurance claim suing for millions of dollar when there is an industry accident and traffic accident and any type of accidents. Do they do that in their own countries? I dont think so! They know Singapore is RICH and can afford to paid and our "CARING" Singaporeans will sympatise with them and pay them hundred of thousands dollar. What about our Poor Singaporean collecting paper cartons, selling tissues papers, eating lefovers at hawker centres etc...?

      he airport, he collapse and die of a heart attack, the judge awarded over $100K and the contractor have to pay. The reason given is he is the only child! China has millions and millions of only child!
      If this happen to a Singaporean, I wonder how the judge will view it.

      On what grounds, SMRT have to pay S$3.4 mil! Everyday accidents occur and we have to see who's at fault and wat causes the accident?

      Singapore is not the only country in the world to have an open platform... many developed countries like japan and hong kong also have open platform...
      they don't blame the gov for not having gates....

      Even singaporean die is their fault why because of their neglecting or unlucky possessed by evil thing!!!

      people donate 200k to Singapore dollar 400k + S$5k(goodwill) is already very kind don't take this for granted!!!!!!!!!

      Netizens beware ... This is going too far.
      I understand the girl family has received $250000 from Red Cross. This is no small money. Now they are asking $3.4M which is monies SMRT receives from us commuters. If the girl is found to be 0% free of contributory negligence, fine - then SMRT should compensate but if someone out that is throwing Singapore a sucker punch - we better beware. It's our money - our contributions ! Wake up, Singaporeans ... we the permanent commuters here must get benefits eg. SMRT must provide more trains with no additional cost to us. We cannot be seen to freely give monies away ... please think carefully before you throw your whole support to her before you hear SMRT side of the story - they have the camera evidence. $3.4M for one person and very soon you will have a lot of people falling on the tracks and it is not like SMRT has committed murder - it is just providing a high-speed transport service so that you can get to the office on time. You are suppose to stand behind the yellow line. Only way you can fall is because you are sick or you got pushed. There is a third way but I will not prejudge. So please - before you start pushing for SMRT to pay more and give away monies contributed by daily commuters of Singapore ... THINK
