    No charges against NYPD boss' son after rape claim

    NEW YORK (AP) — The police commissioner's TV host son has been cleared of the prospect of criminal charges of raping a woman he met for a drink, but it's not clear how quickly he might return to his spot as a jocular morning-show host.

    After prosecutors said Tuesday they hadn't found cause to charge Greg Kelly, he said in a statement that he was looking forward to reappearing soon on local Fox affiliate WNYW-TV's "Good Day New York," but he didn't say when. A representative for the station and a spokesman for Kelly didn't immediately return calls Tuesday night.

    "Good Day New York" on Wednesday reported on the facts of the story without mentioning when Kelly might return.

    The woman told police late last month that Kelly raped her in her lower Manhattan office after they went out for drinks on Oct. 8, assaulting her while she wasn't capable of consenting to sex, a person familiar with the investigation said. She told authorities she became pregnant from the encounter and had an abortion, according to a law enforcement official. Neither was authorized to speak publicly, and they spoke to The Associated Press on the condition of anonymity.

    Prosecutors interviewed "numerous relevant fact and expert witnesses," analyzed receipts, security logs, text messages and telephone records, and they interviewed both the woman and Kelly, the chief of the Manhattan district attorney's office sex crimes unit, Martha Bashford, wrote in a letter Tuesday to Kelly's lawyer, Andrew M. Lankler.

    "After reviewing all of the evidence, we have determined that the facts established during our investigation do not fit the definitions of sexual assault crimes under New York criminal law," Bashford wrote. "Therefore, no criminal charges are appropriate."

    Kelly had vehemently denied doing anything wrong, and he portrayed the prosecutors' conclusions as vindication.

    "I am thankful that the investigation established what I've known all along, that I am innocent of the allegations that were waged against me," Kelly, 43, said in his statement.

    "I am so blessed to have a wonderful family and friends whose support for me never wavered," added Kelly, whose father, Raymond Kelly, has been the city's police boss for a decade after an earlier stint in the 1990s. The commissioner has declined to comment on the allegations.

    The woman, who works at a downtown law firm, told police she met Kelly on the street; they then arranged to meet for drinks three days later at a bar at the nearby South Street Seaport, a second person familiar with the investigation has said, speaking on condition of anonymity to discuss details not made public. The woman and Kelly stayed in contact afterward, the first person said.

    At some point, the woman's boyfriend learned the story and became enraged, that person said.

    While the police department speedily turned the matter over to the DA's office when the woman walked into a police station on Jan. 24, citing the potential conflict of interest in investigating a son of the commissioner, Raymond Kelly was a side note in the story of how the allegations surfaced.

    Before she went to police, the woman's boyfriend confronted the commissioner in person at a public event, saying Greg Kelly had ruined his girlfriend's life but declining to elaborate on the spot when asked what he meant, police spokesman Paul Browne said. The commissioner suggested the boyfriend send him a letter, but the man apparently never did, Browne said.

    The allegation had put Manhattan District Attorney Cyrus R. Vance Jr. in the position of investigating an allegation against a relative of a key law enforcement ally — and presented the first-term DA with another high-profile sex crime investigation less than six months after an attempted rape charge against the former International Monetary Fund leader Dominique Strauss-Kahn collapsed amid doubt about his accuser's trustworthiness. Strauss-Kahn denied the allegations against him.

    Prosecutors do not plan to charge Kelly's accuser with any crime, DA's office spokeswoman Joan Vollero said.

    The AP does not name people who report being sexually assaulted unless they agree to be identified or come forward publicly.

    A former Marine turned TV journalist, Greg Kelly appeared on local stations in New York and Binghamton, N.Y., before joining Fox News in 2002. He covered the Iraq war, including four assignments in Baghdad, and was the White House correspondent from 2005-2007, according to his biography on WNYW's website. In 2007, the television show "Extra" identified him as the most eligible anchorman on TV.

    He has appeared since 2008 on "Good Day New York," taking time off since the allegations surfaced Jan. 25.

    One of his most recent guests before his leave was Vance, discussing the problem of elder abuse and fielding some questions from Kelly about the Strauss-Kahn case.

      So....how many of you can not read? They text one another AFTERWARDS for a while and she only claimed rape because of the boyfriend. She cheated and needed to cover her behind! She deserves to be charged with a crime, women like her hurt the cases of REAL VICTIMS.

      The woman obviously suffered from "Buyer's Regret, " probably because he didn't "Marry" her as he had promised in the HEAT of the moment. Plus she had to pacify the RAGE of her scorned Boy Friend.

      if she was passing out/passed out/unconscious, then yeah, it would be rape, but she just says she was too drunk to give consent. i don't think there is a such thing as that. when you are drunk you can still make decisions. even if you regret those decisions in the morning, you were still capable of making them and just because you made a wrong one doesn't mean you must not have been capable of making a right one, if that makes sense. bottom line is, you can be passed out BECAUSE of alcohol but you can't get raped BECAUSE of alcohol. if this girl was conscious, then she was capable of saying yes or no. just because she was drunk doesn't automatically mean she was incapable of giving consent or not.

        I always found it odd, if a woman is legally drunk she is considered not responsible for your actions enough to consent to sex. If ANYONE commits a crime while legally drunk you are always considered responsible. I agree we should be held responsible as we make the decision to drink that much. Why the double standard?

        i think gordon meant real crimes, any crimes. when people throw rocks through someone's window or get loud and have the police called on them for disturbing the peace...in other words, you can commit a crime, any crime, and being drunk will not excuse you from getting a ticket or getting arrested, so why should having sex while drunk be any different in terms of taking responsibility for one's actions? she still did it whether she was drunk or not. if someone stole your car and then said it was only because they were drunk, you wouldn't buy that excuse for one minute and you would hope that a court wouldn't say, well they were too drunk to NOT steal your car, so.... not that having sex is a crime, of course, but she's claiming that she shouldn't have to take responsibility for her actions simply because she was drunk and would have made a different decision otherwise. this is all assuming that this article is accurate and that she really was quoted as saying that she was drunk so couldn't give consent. when you're drunk you can do lots of things still!

      I am a woman and would be the first to stand up and SCREAM Police cover-up but this woman's story doesn't sit well. She has a boyfriend but meets a stranger on the street and arranges to meet him for drinks, takes him back to HER office where she claims he raped her because she was too drunk to consent. (didn't report it) Became pregnant from this rape... how does she know it wasn't her boyfriends baby? Has an abortion (still doesn't report it) maintains contact with her "rapist" flirting with him through text messaging. (who would maintain contact with their rapist and flirt with them?) Obviously months pass and only after the boyfriend finds out what she had done she cries "rape". This just doesn't pass the sniff test. I have no love for the police, don't trust them and I believe the system is set up to make it difficult for rape victims. That being said I am having a hard time believing this woman's story if for no other reason but that she maintained flirtatious contact with a man she claims raped her. I could believe all the rest, it is the most difficult crime to report. But if you had been legitimately violated you would NOT keep in contact with your rapist. This sounds more like a woman who was trying to cover her behind because she was caught cheating. I HATE even feeling this way.... I know first hand the agony of being raped and there is just no way in heck a woman would maintain flirtatious contact or any contact with a man who violated her. What she has done with this false complaint is make even more "true victims" leery of coming forward and pressing charges because they will not absorb all the facts here and believe the police would never help them. Rape is never a "one time crime", this man would have had other victims and this woman coming forward with this complaint would have given at least ONE other victim the courage to come forward but no one else did. He has no criminal record and no previous or current complaints against him. As much as I hate to say this I don't believe this woman. If there was any shred of truth to her claims there is no way the police would have done a cover-up because this was made very public and being the son of the commissioner means the media would be just waiting for any reason to publicize a cover-up. This woman's own friends are the ones who gave the police the information that she was not being honest. Go back and read the story carefully.......

        You made some very good points, and I very much agree with everything you say, I might also add that when I first hurd about this 2 weeks ago my radar went up when I also hurd how vocal the boyfreind was in press and how long they waited. And no a person raped does not keep contact with the rapist.

      Rape is a serious, damaging crime and should be seriously punished. But then false rape accusations must also be taken seriously by the authorities. This is not a game. Neither being raped OR being falsely accused should be seen as entertainment for the media. Both are extremmely serious crimes with devastating consequences for the victim and their families. US authorities should move to appropriately punish (discourage) false rape accusations while still coming down heavily on genuine rape perpetrators.

      For all of you so quick to say the man's guilty, let's review some facts here: they met Oct 8, allegations were on Jan 24th (several months later), and the boyfriend found out about it. That sounds like she was caught cheating by her man, and yelled rape to save face or they were both in on it.
      Any other person, probably the same result, remember you wash off any evidence with 1 shower, imagine 3 month's worth, nothing of forensic value was left (not even bruises)

      I think that, if a woman gets together with you voluntarily, agrees to go to your house or his house, unless there are obvious physical injuries, there is no way on this planet a man should be charged with rape or a sex crime. I remember when I was 18 and my mom had a very hot friend and she called one day looking for my mom. My mom wasn't home and she asked me if I wanted to come over and "talk". I was pretty clueless at the time and she proceeded to seduce me. I was pretty shocked and she wanted me to spend the night. I told her I couldn't and she got really upset. She then called my home after I had arrived and told me she was going to call the cops and tell them I came over and raped her. For months I was looking over my shoulder, scared the cops were going to arrest me for something I did not do. It upsets me to no end that women can yield this power. What I have done over the years (for my own protection) is to tape (either audio or video) all of my encounters. After the relationship ends (either on good terms or not), I wait 6 months and then destroy the tape. I am always careful now as I know how cruel women can be.

      This whole story sounds just like I suggested it happend when first hearing about it and with what I'm reading it sounds even more like that is the case. What I said was It sounds like he met her and had some kind of encounter, and when the enraged boyfreind found out he got her to go to the police and falsely cry rape, cause it sounded like from the begining he was the most vocal not to mention they waited weeks before going to the police witch to me suggest he just found out his girlfreind met Kelly and got jealous. With that said if the police believe she was lying and if the boyfreind conspired they need to arrest these people, but for some reason they never do and thats wrong. Mr. Kellys job is ruined and it's all because one dirt bag boyfreind and his tramp girlfreind, where's the justice Kelly deserves, and where also is the justice for people like him such as the lacross players a few years ago or the more recent french diplomat, no these tramps that falsely cry rape and destroy another human beings life need to be called on it. Let me also add that Mr.Kelly was also a military pilot who served his country and don't deserve to be only judged as some privileged person just because of who his father is or who he is.

I think they were looking to ruin his son's life and profit from it. As Joe just said "where do I go to get my good name returned".
