    Nude squat case under Malaysia's jurisdiction

    The case of two Singaporean women being forced to perform nude squats while being detained at a Johor detention centre will have to be resolved according to Malaysian laws, rules and regulations said Law and Foreign Affairs Minister K Shanmugam.

    In his reply to a question raised in Parliament on Friday about the June incident, the minister said he understands and shares Singaporeans' concerns over the treatment of the two women who were temporarily detained at the Pekan Nanas Detention Depot.

    The minister shared the last correspondence with the Malaysian High Commission in Singapore on 9 September and was informed that a thorough investigation of the case has been completed. However, the report of the investigation is still being finalised by the Malaysian Attorney General's Chambers, reported Channel NewsAsia.
     
    "We are all aware of recent media reports that the Malaysian Minister for Home Affairs has made a statement on this case to the Malaysian Parliament," said Shanmugam.
     
    "He was reported to have said that based on the probe, the female Malaysian immigration officer had carried out the body search on the two Singaporean women in an orderly manner and the inspection was according to that stated under the Detention Depot's Standard Operating Procedure," added the minister.

    Shanmugam said that Singapore has sought a clarification from both the Malaysian High Commissioner in Singapore and the Malaysian Ministry of Foreign Affairs about the statement because Singapore is unaware and was not informed that investigations have concluded.

    "The Malaysian High Commissioner informed us that it did not have any further information on the Malaysian Minister of Home Affairs' statement in the Malaysian Parliament and that his ministry will be seeking an update from the Malaysian Attorney General's Chambers on the status of the investigation," said Shanmugam.

    The minister revealed that the Malaysian High Commission in Singapore has said it will provide the official report of the investigation as soon as it is available.

    He said: "I know that many Singaporeans are anxious for an expeditious resolution to this case. So are we. We have registered our concerns with our Malaysian counterparts and reminded them of their commitment to conduct a thorough investigation and update us on the outcome of those investigations.

    "We will continue to press for the official investigation report but even as we do this, it is important to bear in mind that this matter would have to be resolved in accordance with Malaysian laws, rules and regulations."

    The minister added that the Immigration and Checkpoints Authority does not track the number of incidents where Singaporean passports do not get stamped at the Johor Bahru immigration unless it is reported to them. The minister also adviced all Singaporeans to check their own passports and ensure that they are stamped whenever they enter or exit the Malaysian customs.

      My friend a chinese national (lady) went to johor on 14 Oct 2011 but the passport was stamped 14 Sep 2011 and small hand written below the stamping 27/9 (she must leave the country by 27 Sep 2011). then 15 Oct 2011 she had problem leaving the country because she was accused of overstaying after 28 Sep 2011 and ask what she do during overstaying. many people check passport for date 14 and skip the month... so better be careful

      Best thing LKY did for Singapore is he got us kicked out of Malaysia unintentionally, and in addition he called Johor a "cowboy town" (proven to be true) which is the few correct statements he had made.After all he is honored for his opinion around the world

      Alas till now there are still a lot of high and mighty red-eye devil with funny hats wandering around thinking they are "big brother (joker)."

      All the thousands of Singaporean that crossed the border are puting themselves and their family at risk. If a person that is stamping passport 8 hours a day, 6 days a week, 24 days a month, 288 days a year, 2880 days for last 10 years, how on earth can he or she forget to stamp one particular passport. I suspect this has always been done intentionally to get back at Singaporean that are silly enough to travel a few hundred Km, brave the traffic jam to save some money.

      There are other alternative countries that are more friendly. You can see from the local comments. Just give us your money. You think you are welcome in Malaysia, I dont think so.

      What KS has said in Parliament is not surprising. PAP only think hard if there is $$$ involved. Unfortunately the 2 poor ladies are humilated and used as pawn in the diplomatic game. There is a conflict of statement made by the Malaysian foreign Minister, what KS had said in Parliament and what Singapore MFA has said.

      Just yesterday LHL had said, he wants minister to be more transparent, I guess KS is not really listening ? Must be really humiliating to pull your ears and do squatting in the nude in the presence of another person ? In a third world country its a normal SOP, what can you expect. Its a high price for a cheap meal.

        Fully agree with you. Those who insist on going to cowboy town do so at their own risk. One may be lucky so far, but all it takes is one incident and they would be lucky if they live to regret going there.

      What KS can do is "looks into the case..." only as a Law and Foreign Affairs Minister. The great million dollars a year Minister, is that all you can do as a minister helming the two ministries? What has KS sweared and taking oath as a cabinet minister appointed by the Prime Minister during the sworn in ceremony at Istana.. "to serve to the best of his ability... safe guarding... the best interest of the nation.. ". By just looking, waiting for report, pressing (sure or not?).. Is that all you can? Is that the best you can?

      What the best KS can do is only what I can see in the parliament debate how he pressed WP MP Pritam Singh for answer for his (PS) personal belief on a question PS asked on control of main stream media like a "court hearing session" grilling the opposition MP. That is the so-called million dollars Minister can do to his best to score point..

      KS, you have not discharge your duty as the Minister of both Law and Foreifn Affairs Ministries until this case is amicably resolved.

      Countries with mutual cordial diplomat ties are obliged to accord a safe passage and ensure the safety and security of each others visiting citizens. Such an understanding are prescribed as a standard request in the citizen's travel document and passport.

      Our citizens reported mistreatment and abuse by the Malaysian Authority is a blatant disrespect and show of disdain to our country, citizen and government.

      This is really a diplomatic issue and a very serious one with serious ramification on how our citizen will be treated at the Malaysian checkpoints.

      It is still not too late for the Singapore Government to sent out a vigorous note of displeasure and obtain an assurance from the Malaysian Government to accord our citizen the due and proper respect and treatment.

      Their arrest was due to their passports not chopped by Malaysian immigration staff, which is their negligence. These two women were subjected to humiliation and their search did not amount to a nude squat search, which are meant for smugglers.
      If Singapre foreign ministry accept this answer, then I do find the minister incapable of doing his job.I can only guess perhaps he has interest over there and dare not offend Malaysia.
      The two women did made a u-turn and approached the Malaysian staff, being honest and yet humiliated in this manner.
      Only an idiot will accept this answer, truly we were being undermined. Minister where is your arrogrance when you talk to us, you are like a pussy cat when you are talking to ue the non- Singaporeans, is there biases on us?

      Generally, they are nice People in Malaysia, However there is exception of a small percentage of Crooks in uniform and they can be very means when provoked. These crooks usually prow for prey during silent hour, probable early twilight or pass mid night.

      I had my own encounter at 2nd link 4 years ago. The exchange happens this way:-
      "Hi Boss, good morning. I need Sing$10/- please put it in the White Card" . I handed him the white card with the $ and he handed me the Passport with a stack of blank White card and we wave bye bye to each other. That's is the close encounter of it' kind. It's a guy age around late 40's or ear;y 50's. In this situation, would you say "NO" ?

      From what I know, carrying out Nude Squats is a very common SOP for Customs, Prisons & Police Stations. It is to ensure that the suspect is not carrying any illegal items ( e.g. drugs ) in his rectum. So, by squatting, the items might fall out.

      However, this is NOT the issue here. It is NOT about the validity of the Nude Squats.

      It is about:
      1. The Malaysian Custom had an UNATTENDED station.
      2. Travellers in the queue going through the Malaysian Custom could simply and would have to drive through in a ONE WAY direction.
      3. The two ladies were the ones who realised that something was wrong and went back to ensure that their passports were rightly processed.
      4. They turned back IMMEDIATELY and they WERE NOT trying to escape or ignore rules but instead trying to make sure everything was done right and that their travel documents were stamped. So, they should NOT have been treated like criminals.

      The issue is simply:
      WHY WERE THEY TREATED LIKE CRIMINALS ?!

      Every country has their set of law, something we cant change. If we cannot agree with them, just boycott them. If their govt choose to live in corruption and backward law, so be it. I will not visit Malaysia unless necessary. I advise all ladies who travel there, "DO NOT TRAVEL ALONE", it's not safe !
