Singapore to extradite four to US over Iraq bombs

A Singapore judge on Friday allowed the extradition to the United States of four Singaporeans accused of illegally selling US-made radio components to Iran that ended up in Iraqi roadside bombs.

The judge ordered the four committed to prison pending an extradition order by Singapore Law Minister K. Shanmugam, who is also the foreign minister.

The US government immediately welcomed the decision even though the four electronics company employees, who strongly denied deliberately violating US laws, were given 15 days to contest the judge's ruling.

"This ruling reflects the strong spirit of cooperation between the United States and Singapore in combating transnational crime, including the illicit trade in arms and equipment that can pose significant threats to the United States and the international community," said US Ambassador David Adelman.

A US embassy statement said the four had been charged with violations of American laws relating to fraud involving the "unlawful export from the United States of military antennas and radio frequency modules".

The four suspects were all in the electronics parts distribution business when they were arrested in October and will be tried in a District of Columbia court if extradited.

"I have no doubt they will be accorded a fair trial by the US courts," District Court Judge Chia Wee Kiat said.

He said all the court needed was to "consider if there is a prima-facie case" and that this had been established during the hearings.

In court statements in December, Wong Yuh Lan, Lim Yong Nam, Lim Kow Seng and Hia Soo Gan Benson rejected US charges that they had conspired to evade a US trade embargo against Tehran.

They were arrested by Singapore police on US charges of illegally exporting US-made radio equipment to Iran including 6,000 radio modules and 55 antenna parts, some of which were found in bombs targeting coalition forces in Iraq.

The Singapore government turned over the US extradition request to a local court to determine the merits of the case.

"I really did not take part in any conspiracy... and I truly did not know that US origin goods were not allowed into Iran," Wong, the only woman among the four, said in a statement read out in court by her lawyer in December.

Wong, who was an office clerk for a company run by an Iranian who is now at large, said her incarceration during the hearings "has caused untold anguish to me, my family and my young children".

Wong's lawyer Ravinderpal Singh said: "I am going to look at the written judgement and decide on the next course of action with my client."

Hamidul Haq, the counsel for the three other accused, said he will lodge an appeal.

"There is a period of 15 days that Singapore has before extradition can take place," Haq told reporters.

So did the four people commit the offense in the US, or did they commit the crime in SG? If they commit the crime in SG, how does US law apply?

If you want to trade with American made equipment that may be on the list of banned things concerning trade with countries like Iran and North Korea then you can be made responsible no matter where you are on the planet.

From now henceforth, the SG government should ask questions to companies exporting to Iran in regards to where the product is made. But other than that, if its made from China, will they still be charged (even though its designed in the US)?
      • V 3 months ago
If the copyright is American, yes.
It's not really that difficult to understand. It's just that you need to do some more work before you just blindly sell things to Iran.

What happens if you are just a clerk carrying out orders of the boss as I think in this case. Correct me if I am wrong, but I think the clerk, and possibly the others might be victims of circumstances. If that's the case why are they being charged ?

When trading with Iran it has been known for years that there are trade sanctions in place for certain goods when the end customer is Iran.
If Singaporeans are as well educated as they usually claim this should not be a surprise and if you are in doubt you just contact the American Embassy. As this case shows it is better to ask once to many than the opposite.

Singaporean have to follow American' law? If crime is comitted in America and these people ran back to Singapore, then Yes. If that ain't the case then I don't think so. Why the government have to pass the buck to the local court is beyond comprehension.

Where got logic in extraditing these 4 Singaporean, especially Wong???
Wong was only an office clerk for a company run by an Iranian who is now at large.
Office clerk a low pay job and now need to come out tonnes of money to engage lawyer to fight of extradition then maybe charges in US. Chances, Wong may just throw in the towel and pleaded guilty unless she really has deep deep pocket. To Wong, I see why she is the most aggreived one.

      Questions
      1. Have Singapore government conducted due diligence prior to agreeing to extradite them
      to US?
      2. Will Singapore be sending representatives to oversee the whole US legal proceeding?

I my opinion, this dicision really sucks. What good is the govt if it cannot even protect its own people? And when war come, it expects the people to do otherwise! What a shame that we had allowed such situation to happen. When are we going to change?

This is not about justice, but the blind adherence to serving the interest of the USA. A young mother who was merely trying to earn a living is now being treated like convicted terrorist. Even if for the sake of argument, she is guilty, she should face trial in Singapore not in the USA. No resident of Singapore is safe anymore.
