QUEZON CITY, Philippines — Based on the decision of the Ombudsman over the Disbursement Acceleration Program (DAP) released on Tuesday, former Department of Budget and Management Secretary Florencio Abad was the only one liable for violating Article 239 or usurpation of legislative powers.
The decision dismayed Bayan Muna Representative Carlos Zarate, one of the complainants in the case.
Zarate is wondering why former President Benigno Aquino is not included in the indictment when, according to Zarate, Aquino was the one who pushed for the implementation of DAP.
The Bayan Muna congressman said, “He is actually the architect of the Disbursement Acceleration Program, both of them are the authors. When we say the agent is accountable, so must be also the principal.”
The Omdudsman found Abad guilty of simple misconduct and ordered to pay a fine equivalent to three months’ worth of salary.
Meanwhile Abad welcomes the decision of the Ombudsman to drop the graft, corruption and technical malversation case against him.
In a statement issued by Abad, he said that he did not benefit from the implementation of DAP and will never use public fund for personal gains.
Zarate opposes the statement and maintains that the implementation of DAP was done in bad faith.
“We think this is in bad faith, they are not simple employees of government because they are former law makers and they know the role of the Congress in terms of budget and also the role of the executive in implementing the budget,” he said.
Zarate’s camp will study the decision of the Ombudsman before filing a motion for reconsideration to include again the former president aquino in their complaint. — Mon Jocson | UNTV News & Rescue
