Kasambahay law implementing rules issued

Manila, Philippines -- With more skills, comes higher pay.

Professional house hold service workers (HSWs) could now command a higher price in the labor market if they can get TESDA certification for their skills under the Implementing Rules and Regulation (IRR) of Republic Act No. 10361 or the Kasambahay Law issued by the Department of Labor and Employment (DOLE) yesterday.

According to the IRR, the Regional Tripartite Wages and Productivity Boards (RTWPB) would be required to issue wage advisories which could later lead to increases in their pay.

The Kasambahay Law mandates HSWs in the National Capital Region (NCR) should receive at least P2,500 minimum wage. Meanwhile, HSWs in the first class municipalities should get P2,000, while those in other municipal class should get P1, 500.

After a year of effectivity, the IRR would require the National Wage and Productivity Commission (NWPC) to review these rates and adjust it based from the "peculiarities of the Kasambahay employment arrangement."

HSWs are exempted from the minimum wage orders issued by the RTWPBs.

However, HSWs may be entitled to additional pay if they would undergo more skills training at the Technical Education and Skills Development Authority (TESDA), which it will launch by the end of the year.

Under the training program, household help could gain a National Certificate for the following competencies: Cleaning living room, dining room, bedroom, toilet, and kitchen; washing and ironing clothes, linen, and fabric; preparing hot and cold meals/food; serving food and beverage.

"The National Wages and Productivity Commission (NWPC)/RTWPBs shall coordinate with TESDA on the development of a skills/competency-based pay system in line with the thrust to professionalize the Kasambahay," the IRR said.

"Wage advisories containing a range of wage increase on top of the minimum wage shall be issued by the RTWPBs taking into consideration the competency standards set by TESDA," it added.

The IRR was issued yesterday by the Department of Labor and Employment (DOLE) at the Department of Education Central Office in Pasig City.
