Man who allegedly raped daughter twice claims she initiated sex
SINGAPORE — A father who is accused of raping his older daughter twice and forcing her to perform sexual acts on him in 2016 claimed that the acts were consensual and initiated by the alleged victim.
The 52-year-old man testified that his daughter, then 23, whom he shared a room with, had pulled his shirt after he turned off the lights in the wee hours of 25 March 2016, telling him that she was “horny”.
Opening the defence’s case on Monday (18 November), lawyer Lau Wen Jin told the court that the charge of of rape should be amended to incest.
In the event that the defence fails to argue its case that the sexual acts were consensual, Lau said he would rely on the defence that the man had mistaken his daughter’s consent.
The man also has a younger daughter and a son.
In March 2016, the older daughter was unemployed and had chronic alcoholism since at least 2015, Lau told the court. She also took methamphetamine after the alleged rape incident, he added.
The woman, now 27, also had relationship problems with her husband and blamed her father for her failed marriage.
It was her mother, who is divorced from her father, who filed a police report after she felt offended by the way her ex-husband had touched their daughter, said the lawyer.
The man, who cannot be named to protect his daughter’s identity, is contesting nine charges, including aggravated rape, aggravated sexual assault by penetration, aggravated molest, and criminal intimidation.
He is accused of holding a penknife against his daughter’s neck on 27 March 2016 between 3am and 6am and later committing the sexual offences against her.
Daughter made the first move: Accused
According to the man’s testimony, he first had consensual sex twice with his daughter on 25 March 2016, after consuming alcohol with her.
At about 4am, as the two were in the room, his daughter kissed him and made him perform sexual acts on her, the man said. Nobody else was at home at the time, according to him.
“She held onto my waist, I kept on looking at her face. I knew that I was making a mistake.
“I was thinking in my mind I’m not her husband and I’m not her lover. I do not know whether she understood that or not but she felt that her horny feeling was more important so she told me to do it,” he said.
He eventually gave in to her and had unprotected sex with his daughter. After the first encounter, the daughter allegedly requested for her father to “make her happy again”.
The man complied as he knew that his daughter would be angry if he did not.
When asked if he had at any point stopped her, the man said that he had initially told her, “We shouldn’t do such a thing”.
“She said she felt horny and she said cannot control herself and she said that there was no one at home and told me to do it and make her happy,” he said.
He added that he had never hit her and would just give in to her, even if she scolded him.
“Her happiness is everything to her and only her happiness is important for her, she doesn’t care about what others will think.”
The man left for work later that morning after promising his daughter not to reveal the incident to anyone else. He testified that he was unable to work properly as he kept tearing and making mistakes.
Two days later, the two repeated the acts in the bedroom, with the daughter forcing herself on him, according to the man. He became emotional when recounting the incident.
“I told her, ‘Can’t you see that I’m your father?’ I asked her if I was her husband or lover...She told me to do it,” he said tearfully.
The man was also asked about two penknives that he had in his possession, including the one that he allegedly used in the incident. He said his company had given them to him for opening boxes and containers, and denied taking out them out on 27 March.
“If I wanted to slash her I would slash her on the day itself, why would I want to use the knife and threaten her?
“She told me to stay in the house and made me pay for this and that and now she’s telling such lies. I swear upon my mother that I did not use the knife at all.”
Daughter would “sayang” me: Accused
Describing his relationship with his older daughter then, the man said that she was “loving” and spoke to him openly about her problems. He also advised her against her husband, whom he saw as a good for nothing.
His daughter would also “sayang” him by kissing his cheeks and massaging him.
He added that in 2014 after he was released from prison for an offence of robbery, he discovered that his two daughters were taking drugs at home and threatened to report them to the police.
“I told them that if they are not going to reform I will join them and start taking drugs together with them,” he said.
The man made good on his promise and began taking methamphetamine, but his older daughter reported him to the police in February 2015. He was sent to the drug rehabilitation centre and returned home in 2016.
The trial continues on Monday.
