SINGAPORE — A 35-year-old man who had just defecated at a public toilet looked up to see the camera lens of a mobile phone pointed at him, a court heard.

The victim immediately went to the next cubicle and confronted the culprit, Alton Keh Guan Qing, whose phone contained multiple photos and videos of other males using public toilets.

At the State Courts on Monday (16 December), Keh was jailed for 12 weeks and fined $3,000.

The 27-year-old Singaporean pleaded guilty to 14 charges - two counts of public nuisance, 11 counts of making obscene films and 1 count of possession of a film without a valid certificate.

At the time of the offences, Keh was a cabin crew with low-cost airline Scoot. He is no longer with the airline.

On 5 May last year, the 35-year-old victim went to use the toilet at Basement 2 of Chinatown Point at about 3.15pm. He heard a noise from above after he had finished using the toilet, while he was still in the cubicle.

The victim then grabbed Keh’s mobile phone, but couldn’t find any photos or videos of himself. But he saw videos and photos of other males on the device, and called the police.

Keh admitted during police investigations to taking one photo of the victim defecating, by positioning his phone at the top of the cubicle partition. He deleted the photo when he realised that he had been spotted.

Between 18 March and 27 April last year, Keh took photos or videos of other exposed men using various public toilets on at least 13 other occasions.

On 24 March for instance, he took a video of a man urinating inside a toilet cubicle at City Square Mall. A month later, on 24 April, he filmed a man who was sitting on a toilet seat at Chinatown Point.

The next day, Keh recorded another man defecating inside the toilet at City Square Mall.

Keh also recorded a man performing fellatio on another man in an adjacent toilet cubicle at an unknown location on 21 March. A month later, on 21 April, he took a video of a man showering at an unknown location.

On 20 March, Keh filmed a man sitting on a toilet seat and stroking his penis at City Square Mall. He also recorded another man doing the same thing at the same mall on 27 April.

The maximum punishment for public nuisance is a $1,000 fine.

For making obscene films, Keh could have been fined up to $40,000 and jailed for up to two years, per charge.

The maximum penalty for possession of a film without a valid certificate is a fine of up to $40,000 and up to six months’ jail.
