Teen who raped 10-year-old sister after watching porn given 21 months' probation

A teenager who raped his then 10-year-old sister after watching pornography was on Wednesday (8 August) sentenced to 21 months’ probation and 180 hours of community service.

The 17-year-old boy, who cannot be named to protect the identity of the victim, had first sexually abused his sister in 2013.

The court heard that the boy, then 12 years old, began watching pornography online in the same year but was initially disgusted by it. He, however, developed an interest in it and felt the urge to re-enact what he had watched, court documents showed. He began to surf pornographic websites more regularly.

In September 2013, while the boy and his sister were at their flat alone, he became aroused after watching a television show that depicted a bedroom scene.

The boy then called his sister to his room, on the pretext of wanting to “try something with her” and threatened to report her mobile phone usage to their parents if she did not comply.

He told the victim to strip, while he removed his shorts and proceeded to molest her. He then penetrated her without a condom, only stopping when his sister complained of pain and discomfort.

After finding out that their son had been touching his sister’s breasts and private parts on several occasions, the parents sent both siblings to see a counsellor from the Counselling and Care Centre in 2014.

Court documents showed that no police report was lodged then and arrangements were made for the boy to stay at his grandparents’ home to keep him away from his sister.

The boy was allowed to move back to the family home after six months of counselling. The parents also closely supervised their children and implemented house rules to prevent the boy from committing similar offences.

However, in August 2016, the siblings’ mother shared with the counsellor that her son, then 15, had continued to sexually abuse the victim, then 13.

Court documents showed that the boy had begun watching pornography again due to the stress over his studies. On one night, the boy felt a strong sexual urge and told his sister to go into his bedroom. There, the boy molested her under her clothes.

In April 2017, the victim was accompanied by her parents and a Ministry of Social and Family Development’s Child Protective Service worker to lodge a police report.

The boy, who was unrepresented, pleaded guilty in June to one count of sexually penetrating a minor under 16 and one count of using criminal force to outrage the modesty of his sister. Six other similar charges were taken into consideration for his sentencing.

“He went on to commit sexual acts against the victim since she was in close proximity to him, and also because he was confident that she would not disclose what he did to her to others,” said Deputy Public Prosecutor Raja Mohan in June.

During his probation, the boy has to remain indoors from 10pm till 6am as well as undergo counselling and psychological treatment. An internet filter service will be installed on his communication devices – which include laptop, personal computer, and mobile phone – for the parents to monitor his internet usage.

He is also only permitted to stay at a residence with no females below 16 years old and approved by a probation officer. All contact with his sister will be supervised by an adult.

For penetrating a minor, the boy could have been jailed 20 years and fined or caned.

For outraging the modesty of a minor, he could have been jailed five years and fined or caned, or with any combination of such punishments.
