Mom Who Fell Off 'Beast' on Dr. Seuss Carousel Suing Universal After Allegedly Suffering ‘Permanent Injuries’

In the lawsuit obtained by PEOPLE, the family is alleging that the theme park did not warn them of any “falling hazard” before they got on the ride

A park-goer is suing Universal Orlando for alleged negligence after she fell off the Caro-Seuss-El ride and allegedly sustained "permanent injuries."

According to the lawsuit filed Friday and obtained by PEOPLE, Juliana Asquino was dismounting a “beast” on the Dr. Seuss-themed ride when she fell “due to the negligent design of the Caro-Seuss-El” that had “no warning signs advising of the dangerous condition and/or falling hazard.”

She was visiting the Orlando, Fla. theme park from São Paulo, Brazil, with her husband, Rafael, and daughter in June 2022 when the incident occurred.

As a result of the fall, the suit claims Juliana sustained “severe personal injuries” and has accumulated medical expenses for her treatment. The family is asking for damages amounting to more than $50,000.

A representative for Universal Orlando did not immediately respond to PEOPLE'S request for comment.

The family is also seeking compensation for the impact that the fall has allegedly had on each member.

Rafael claims to have been affected by his wife’s injuries because she is now limited in her capabilities regarding her “family relationship duties.”

Their daughter, Giovana, has also allegedly “suffered extreme emotional trauma” after witnessing her mom's fall and riding in the ambulance with her after the incident.

The filing claims that Universal Orlando is directly responsible for the damages due to “the actions and inactions of its agents, apparent agents, including, but not limited to, the employees who were responsible for maintaining and supervising the park.”

The Caro-Seuss-el, located in Universal's Islands of Adventure park, is a family-friendly attraction with no minimum-height requirement, though any rider under 48 in. must have a companion. The merry-go-round's mounts include elephant birds from Horton Hatches the Egg, cowfish from McElligot's Pool, and Mulligatawnies from If I Ran the Zoo. The characters are interactive and can be controlled by pulling on their reins. Their "eyes blink, ears wiggle and heads turn," according to Universal's website.

According to Universal's Rider Safety guidelines, "Ride Warning Signs can be found at the entrance of each ride." The site advices riders read health and safety requirements for each ride and know their physical limitations before boarding.

Specific guidelines for Caro-Seuss-el posted online state riders "must be able to take a step up and onto the carousel platform and climb onboard the Seussian creature, either independently or with assistance from your companion." Chariots are available for riders with various physical limitations and infants.
