Tori Spelling Seeks Sole Physical, Joint Legal Custody of Her Five Kids with Dean McDermott in Divorce Filing

The filing obtained by PEOPLE comes nine months after the couple first separated

Tori Spelling is working out custody of her children amid her split from Dean McDermott.

In court documents obtained by PEOPLE, the Beverly Hills, 90210 alum, 50, filed for divorce from the Canadian actor, 57, citing irreconcilable differences as the reason behind their split.

Regarding custody of her five children — Beau, 7, Finn, 11, Hattie, 12, and Stella, 15, and Liam, 17 — Spelling is calling for sole physical and joint legal custody, with visitation time allowed for McDermott.

McDermott announced his split from Spelling after 18 years of marriage in an Instagram post in June, on the same day listed as the day of separation in the filing. He cited that the pair "have decided to go our separate ways," but deleted the post shortly afterward.

In photos obtained by Page Six earlier this month, Spelling and McDermott were snapped speaking with each other at a park in Agoura Hills, California.

Representatives for both Spelling and McDermott did not immediately respond to PEOPLE's request for comment.

In December, Spelling enjoyed time out with her four younger kids at Jingle Ball 2023 and opened up about needing family time after a "challenging" year.
